hey all,
I have a rather simple question about renting an apartment with another person. My girlfriend and I rented a one bedroom suite a couple of months ago. However, it looks like the relationship is ending. My question is if we each have signed our name to the lease agreement, and one partner takes off and leaves the other to pay for the entire amount, can you demand that the partner that is planning on vacating the suite pay 1/2 the amount of the rent (as per the original lease agreement) until the suite's lease either ends or the landlord gives permission to sublet. Any input would be greatly appreciated. Thanks.

Sorry to hear that bud break ups suck. I'm not a lawyer or a landlord thus I cannot say 100% but I would think that if her name is still on the lease she can't just ditch it and leave you to take care of it. I recomend you talk to your landlord as he/she should know what the procedure is in this scenario and if that doesnt do any good perhaps talk to a lawyer.

EDIT: I did some looking around, couldnt find anything specific to Manitoba but in other provinces (should be similar regulation in MB) The vacating roomate is to give 30 days notice to you and the landlord and since her name is on the lease she is responsible for her share of the rent until you have another roomate.

I would look at getting a lawyer.
Is she moving out of province? May be hard to collect from her.
I would let your landlord know right away what is happening too. This is probably something that happens often
