Tim Danson, the Toronto lawyer representing Moore, says Ontario's Superior Court of Justice has scheduled to start hearing the case on Sept. 24, 2012, if Bertuzzi is still playing in the NHL. If Bertuzzi has retired, Danson says the lawsuit, which seeks more than $40 million in damages against Bertuzzi and the Vancouver Canucks, will begin on Oct. 22, 2012. Playing for the Canucks on March 8, 2004, Bertuzzi punched Colorado's Moore from behind then fell on him and pushed his head into the ice. Moore suffered three fractured vertebrae and a concussion and has not played since. Bertuzzi pleaded guilty to assault in criminal court and was sentenced to one year of probation and 80 days of community service.

i guess Lindros should be looking for compensation for getting concussed and having his career ended too? or Kariya, or LaFontaine?....or the many, many other ex players who's careers were cut short due to getting injured. Moore is a little bitch. his hit on Naslund was dirty too. you play in the dirt, your gonna get dirty.

Dude the cheapshots on Kariya, LalFontaine etc, were really dirty but they werent near as bad as Bertuzzi's sucker punch, hence the fact that what Bertuzzi did merrited criminal charges that he eventually plea bargained and got off with a light punishment considering he could have been potentially facing jail time. Regardless of Moore's hit nothing justifies what Bertuzzi did, the whole thing is ridiculous. Moore owned up and fought Matt Cooke who isnt exactly a teddy bear, what would have changed if he fought Bertuzzi? Nothing. Oh and on a side note there is a fine line between a career being cut short and a career ending. Kariya played many seasons after that bs headshot, Moore was injured far longer. I'll meet you halfway ish and admit the whole things with Moore's parents suing is bs but ultimately with a big ass law suite like this there are lotsa tactics employed and it turns into a big gongshow. Bertuzzi offered more I believe $375, 000 or something like that to settle, that was just plain stupid if Bertuzzi manned up and made a decent offer we wouldnt be having this conversation.

Bertuzzi's criminal trial that I mentioned previously ended a long time ago but now this is about Moore's civil suit. Cases like this can drag on for a long long time in court so its not exactly a shocker really. Again Bertuzzi should have just bit the bullet and made a bigger offer.

It's one thing getting injured by accident, but totally different when you're pummeled from behind and your career comes to a sudden end.

I'm not a lawyer at all so I have no idea what the odds of him being convited were but the reality is he could have done time. Uhhh Mcguire can't we have a serious conversation? Obviously he didnt just punch and fall on him. Clearly you arent a lawyer either as the lawyer doesnt have the legal right to enter his clients plea, meaning Bertuzzi made the decision with advice from his lawyer who weighed out the possibilities. Regardless of whether Bertuzzi intended to fall on him or not, if you watch slowly you see that once he lands on him Bertuzzi attempts to punch Moore again meaning he was clearly in control of his actions, he wasnt stumbling. From a legal aspect what Moore's lawyer will argue is that regardless of when the injury occured Bertuzzi is 100% responsible which he is. What would have happened if they had just let Bertuzzi sit on him and continue to sucker punch him? Fact is Bertuzzi should have made a big offer to settle outside of court. Now he's gonna have to pay through his big nose.

Where the rebutall Lizzie Mcguire?
Anyways while I have a chance I thought I would adress 2 points about Bertuzzi's sucker punch
1) Bertuzzi accidentally "fell" on Moore. Well when Bertuzzi decided to sucker punch Moore like a teenager throwing a temper tantrum, he didnt seem to realize that when Moore went down from the punch Bertuzzi would go down with him since he was holding onto him. Take a look at the video below, watch Bertuzzi's left hand closely at 1:43, you can clearly see that Bertuzzi is about to sucker punch Moore YET AGAIN, apparently 1 sucker punch isnt enough for him. Luckily one of Moore's team mates prevented it.
2) Its the Avalanche player fault for piling on. I love when I hear people spew that bs excuse. People who use that excuse are tiehr blind or too stupid to actually watch what happens. Again watch the video and watch closely what happens after Bertuzzi landed on him, one Avalanche player tries to get him off and 2 idiot Canuck players decide to jump in. Oh and
As I already pointed out Moore already fought Matt Cooke, one the dirtiest players in the league. Nothing would have changed had Moore fought Bertuzzi. What would that have accomplished? Nothing, next thing Brad May or some other Canuck clown would have been waiting in line to fight Moore over a borderline hit.

As much as I dislike Bertuzzi as a player and that WAS a cheap, cheap shot...
That was years ago already!
If they were going to do this, why now and not all those years ago?

Dude cases like this dont get setteled quickly, it takes a long long time I think Moore filed the suit in 06, its not his fault the legal system is slower than a snail
